The Low-Income Housing Tax Credit (LIHTC) funds the creation and preservation of housing for low-income households. LIHTC is a federally funded program, but every state uses its own housing finance agency (HFA) to decide how to allocate its LIHTC dollars most appropriately. LIHTC is an important resource but cannot be relied upon as the sole source of funding for affordable housing. In addition, LIHTC tenants need new protections to ensure they are treated fairly. NLIHC is advocating for essential LIHTC reforms in a tax extenders package, including reforms that:
- Incentivize serving extremely low-income households and those experiencing homelessness.
- Encourage more development in tribal nations.
- Create more affordable homes in rural communities.
- Clarify and strengthen nonprofits’ Right of First Refusal (ROFR).
- Ensure data transparency.
- Extend tenant protection for tenants of LIHTC properties.
NLIHC currently endorses the “Affordable Housing Credit Improvement Act” (S.1136; H.R. 2573), which includes most of these reforms. Likewise, the “Decent, Affordable, Safe and Housing for All (DASH) Act” (S. 2820) includes additional reforms, like a provision requiring that 10% of tax credits be set aside to help offset the cost of building LIHTC homes and another provision that eliminates the “Qualified Contract” loophole from the LIHTC program.
